Both of these are easy - the android security/security audit is a joke.
Devices "with root access" aren't blocked - all the jf roms get all the
(regionally available) apps with no problems. (There is an overly-complex
system of properties and checkin service that determines what you see. Its
pretty well made of fail and easily broken.)

And protected apps are easy to access on dev/root devices because the
prevailing attitude on protection (according to talking to the devs) is "it
can't be perfect so why try. It works on stock. Suggestions welcome but if
its not 100% its not worthwhile."
