What makes you so sure that they've modified the kernel and that their closed 
source custom boot loader that requires a crypto signature, module, or 
something else which can be achieved without modifying the kernel source?

The Linux kernel is licensed under the GPLv2 license, which stipulates
(paraphrased) that source code for modifications to the code licensed
by the GPLv2 be provided upon request. There are custom kernel
modifications made to the kernel for the ROGERS DREAM required for it
to boot -- it is not compatible with kernels compiled for non-rogers
dream.

Thus far, HTC Corp. has refused to provide the source for their kernel
patches in clear violation of the GPL.
