Could people use your app without errors being raised if they don't have the Android Market installed?
If not, then Amazon has a valid point. They don't want apps with functionality that would frustrate their customers. If you handle it gracefully, though (e.g. you offer to search on Android Market only if it's present) and Amazon still complains about it, then that would be wrong i think. In short, if uploading your app to any other market than the Android Market, your app should not assume the 'market:' scheme can always be handled by the customer's device.
