@Cory One more trick you could try, that has worked successfully for me on some things. Please note that this is just my theory and i am nto a lawyer. This should not be taken as legal advice, as only a licensed lawyer can provide such.
The Bar association in most states has a lawyer referral service. YOu clal them and tell them what you need and they will give you the number of an appropriate attorney. Those attorneys agree to do an initial 15 minute consult for something like $25.00 (may be a bit more now, it was years ago last time I did this.) So you explain the situation to the lawyer and get his/her verbal opinion that, because you do no in app purchases, this patent has no baring on your app. Then you write a letter something liek thuis: Dear Sir: I have consulted with my attorney and he informs me that, as my app provides no in app purchase option to the user, your patent does not apply. If you believe differently, please respond within 30 days with a written explaination of how your patent is specifically infringed in my particular application. Best Regards etc... Save a dated copy of the letter. If they dont respond within 30 days, you can sleep pretty easy...
