On the other hand, you can sell content for your app (e.g., MP3 files, books) without going through Google Play. If what you're selling can be packaged as content, you might be able to get away with it. Content is more than "flip a switch in the app", but there's no reason (on Android) the content couldn't include downloadable code.
As TreKing said, though, consult a lawyer to get a full picture of your risk profile.
