We've been talking about this for months, Sam.
As I said recently: "it's the page designers who aren't compliant
(in not commenting out the scripting), but from _their_ point of
view, users of non-Java-aware browsers are the ones who are non-compliant."
They can check their site stats and see that over 90% of their visitors
are using IE5. It's a hassle for Arachne users, so Arachne needs to change
her skirt. Similar situations occur for anyone who goes against the grain.
You either adapt as best you can and/or campaign for a change.
I still question the title of this thread. Correctly commented JavaScript
isn't a problem. Is it?
