Huh?  How are they excluded?

I think this change should apply to the free pool as well. Obviously hoarding isn't good but there is only so much that can be done to prevent it. If some extra allocations happen then that means we are just closer to IPv6 and whatever IPv4 market happens with legacy blocks that become available one way or another after ARINs free pool exhaustion.

I strongly disagree this should apply to the free pool. If it were, there would be nothing stopping me from getting IPv4 space, selling it on the transfer market, then coming back for more, time and time again, until the free pool is exhausted.
