Chill out mate, you are on about too much technical stuff and you are simply missing the point. Moreover, hell bent on your opinion, atleast respect what academy (a vote from musicians) had to say today.

I've mentioned this earlier-- unlike previous awards like BFCA, Golden Globes & BAFTA, the Oscar nominations are decided based on votes from members in the related categories.
