In most other open-source projects there is no difference between releasing a patch and contributing to the codebase because the maintainers immediately take that patch and commit it to the codebase after adequate review and editing.
The disclaimer is really a Digium (well, "Linux Support Services, Inc.") thing more than it is an Asterisk thing.
If there were a competitive fork of Asterisk (gasp!) out there, then those codebase maintainers could accept Broadvoice's released patch as a contribution and commit it to the codebase without any said disclaimer.
So the dilemma of patch release vs. contribution isn't really a Broadvoice's issue, it's Digium's.
