Please spend a few minutes using google on this topic. We had a long drawn out thread about this before. Some people from time to time think they have figured out how to get around the patents. The rest of us remind them that the patents are secured by large corporations from around the world and some with world wide reach. The patents are worded specifically to have made it through even in the places that don't allow software patents. You will find that the patent holders tend to discourage any usage that isn't easily inventoried such as in a chip.
