There is a big difference between opensource and free to use. Lets not confuse that. I know its not a opensource project with a GPL licence structure, if that is what you mean.
(in the meanwhile, we've bought licences from Digium now. It was too complicated to contact the patent holders to make a deal)

Please be aware that your licenses from Digium grant you specific rights to use their implementation, not someone else's. In AstLinux this is a good thing because Digium's codecs are the only ones that work!
