audio over HDMI has to requirements, a) need to use the correct audio device, the normal Linux stuff exposes two devices, there's a third for HDMI audio and b) the nvidia video driver needs to know how to interleave the audio into the digital video output. Someone already did the work to expose the third audio device a few months back and passed this to the ALSA devs. It's in a ticket on ALSA. Not sure if it went into ALSA source code. The current nvidia driver should have the b) part.
