Something like this happened with taping radio.  Eventually congress
passed a law which explicitly legalized it, ending the recording
industry's efforts to prosecute people for it.  Imagine the uproar if
they tried to make CD rips illegal and/or subject to some fee - people
would scream far louder than they did in any debate over tapes from
radio.  I can't imagine politicians sitting still in that case, no
matter how much money the RIAA threw at them (but then again I'm an
optimist by nature).
