Here are the differences which may be related to your problem, between
aufs in ubuntu and latest aufs3.13.

- the filepath in /proc/PID/maps may be incorrect.
I am not sure wheter this problem surely happens or not and whether it
is related to your problem or not.

- fallocate(2) in aufs is not supported.
- O_TMPFILE for aure is not supported.
if your rsync (or related processes) are depending these rather new
  features, then errors should happen.

- a few recently fixed bugs
bed6fd0 2014-07-18 aufs: bugfix, restore the lost unlock in an error
path
0a0de13 2014-07-25 aufs: bugfix, stop passing an error code to dput()
  are not merged.
the former one may be related to your problem. if this bug appears,
then it _may_ look like your problem (I am not sure). the latter one
triggers the kernel oops at once.

- recent vfs-ino.patch and tmpfs-idr are not applied.
if you get zero as an inode number on tmpfs (or else), then you may
not able to see the file. I don't know how important for your rsync
(and others), and I am not sure it is related to your problem.

- there are more features added, but they seem unrelated.
