I tried the aufs-4.4 Linux tree from git
   ([1]git://github.com/sfjro/aufs4-linux.git)
   I still see these "text file busy" errors. The errors happen in a chroot
   environment of the aufs mountpoint.
   I have verified that the errors do not occur in Ubuntu 12.04 (kernel 3.2.0).
   Do  you  know  of any special consideration for using AUFS in a chroot
   environment ?

     Your kernel, Ubuntu 14.04.3, is modified by ubuntu. For me, it is hard
     to support non-vanilla kernel, because I am not an ubuntu user and I
     have to check the modifications made by ubuntu people. If I had enough
     time, I would try. But unfortunately (or fortunately) I am very busy
     now. So if you can, try reproducing the problem on the vanilla kernel.

     I saw one guy reported the problem happend with overlayfs.

     I also had this issue.
     Using docker 1.7.1 with overlay.
     Running sync in between fixed it.
