I would have thought once in a thermal both / all gliders are responsible for maintaining separation. Good airmanship is required, which is possibly where the discussion started. e.g. an aggressive pilot flying alongside a low experience pilot. Dangerous flying should be discussed between pilots first and if nothing is resolved move the discussion up through the established disciplinary path. I for one don't continue into dangerous situations whilst reciting "I have the right of way".
