Has someone changed the Australian definition of VMC? It used to be 1000 feet clearance above or below cloud when above 3000AMSL or more than 1000feet AGL.
Below 3000 AMSL or within 1000 feet of terrain you could fly clear of cloud but were required to carry and use radio. So anyone climbing to cloudbase and pushing forward into shear wave and climbing up the front of the cloud (horizontal clearance from the cloud?) is breaking the Civil Aviation Regulations as surely as anyone climbing inside the cloud.
