And there were severe penalties if an immigrant did not register - whether or not they came legally. If you are looking at the 1940 U.S. Census, there is a column that states whether they are naturalized, alien, or papers filed to become a citizen. So if that column doesn't say "Na" (for naturalized), then the Alien Registration should be ordered.
