Interesting question and one argued about here in relation to the recent supreme court ruling: http://www.salon.com/news/feature/2005/06/28/grokster/index.html (short summary: google break copyright much more than e.g. grokster by providing new filtered versions of normally fiercely defended copyright content e.g. BBC News images on news.google.co.uk)
Have the BBC done anything about it up until now? Not that I'm aware of. And while it remains RSS-like and essentially drives traffic back to our full-site content, should we care? Personally, I don't think so.
