Perhaps I should have pointed out that I always work out of BBEdit's
projects these days. The docs are then "stacked" in the same window.

The logic of the diff is:

Two docs open - feature available.
Two docs + scratchpad open - feature not available.
One doc + scratchpad open - feature not available.

Hence my suggestion for a small improvement where the scratchpad is
never considered part of the equation.

I'll add a user scenario where this change makes some sense (at least
to me): Working in projects, the screen is typically filled with your
file list and editing view. If the scratchpad is open, I tend to
toggle it and the project window with Exposé. This means that the
scratchpad for the most part is hidden while open. Selecting two docs
for a diff in your project may then produce somewhat of a puzzling
suprise since, based on user experience, the menu item should be
active. Without the scratchpad open, in this case hidden behind your
project window, it works as normal and expected. Once I discovered the
cause of the missing menu item, it was of course no longer a mystery.
But I did ponder what seemed like a bug for more than one diff.

In great software, one can only suggest the most minute and almost
useless improvements, right?
