David Woodhouse made a patch for this. Linus pulled it into his tree last night, commit 178e0cc5ff249965c6cfbd78b1af6a5e614d837c. Try the latest -git kernel and try to recreate the problem. The patch was also send to this list, search the archives for "[PATCH] bcm43xx: Fix access to non-existent PHY registers".
