For sanity sake, can you test if this was fixed in a later kernel, via:

cd /opt/scripts/tools/
sudo ./update_kernel.sh --beta-kernel
sudo reboot


#This will return you to the default v3.8
cd /opt/scripts/tools/
sudo ./update_kernel.sh
sudo reboot
