While this statute truly sucks, note that it does NOT allow mopeds to be driven on sidewalks to reach the bike racks. (Another statute specifically prohibits driving motor vehicles on sidewalks.) Unfortunately, this is apparently beyond the comprehension of many moped operators.

Or perhaps many (most? all?) moped operators assume that since it's legal to park there, it's legal to drive to up to the racks. I'm not sure the moped driver can be faulted for driving across 4' of sidewalk to get to a rack where she's legally allowed to park.
