I am glad this subject came up here.  After reading about this
crash in the WSJ and TCT, a rant started to develop.  I started to go
over the whole scenario from a legal standpoint and was going to post it
here, but instead I’ll sum it up:

1) Too many motorists are ignorant of how to operate a motor vehicle
safely at night. Most notably, many drive as if there is an infinitely
long stretch of defect-free pavement in front of them that is guaranteed
to be occupied only by other motor vehicles traveling in an entirely
predictable fashion.

2) The Police generally aren't in the business of trying to change the
culture described in #1.  In fact, they sometimes promote this culture.

3) So as a bicyclist, given #1 & #2, you are on your own.  Wear a
helmet, use a front light, a rear reflector (a rear red light is
better), and go buy a reflective vest to wear at night (if you don't
already have one of those cool reflective jackets that the likes of Mike
Barrett tend to wear).  Oh, and it wouldn't hurt to write a letter to a
government official complaining about #1 & #2. 

I'm out there on the roads at 6:00am every weekday on my bike - I hope
to see a lot of you out there too!

Inattentive driving?  Deer don't wear reflective clothing or carry
lights, and you're still responsible to watch out for them!   Besides,
what about the headlights on the truck?   One also has to wonder how
fast the vehicle was moving?
