Wow. 9 AM (daylight), and she was biking on the shoulder. The sunlight would have been behind her (although I think this morning is was cloudy and/or a few drops of rain, but not enough for that to be a factor), so the driver couldn't say the sun was in his eyes.
Driver veers onto the shoulder. "Inattentive driving appears to be a factor in the crash...." How bad do things have to be for a driver to be charged?
