I know people who make it their business to pursue companies that do not honour OSS licenses. The companies always have to retrack. Is there any precedent in science where open source software was used to scoop research? And how did that scientist fare? With scientists I can't see it happening. Getting caught out that way will hurt all future prospects for an individual or group. With this reasoning you are best off putting code in the public domain as fast as possible.
