The new contract in May which let them get out of the mandatory
divestiture and gave them .com in perpetuity also did a lot of damage
to the previous "mandatory separation" rules.   (This is the contract
that they extorted out of ICANN, DOC, and the internet community by
telling it that they had found a loop hole in the divestiture and that
if they were forced to go forward with it they would not comply with
the spirit of the original agreement but would use this loophole they
claimed that would let them "sell" the registrar, but keep all the
business from it)

So I don't know that it really makes much difference anymore to
differentiate except for the actual functions.  Both are snakes.
