Wouldn't that be because the person is giving away the copy and thus not 
actually gaining anything except having owned that copy for however long 
he/she had it before giving it away? There are a lot of CDs that I own but 
haven't listened to in ages. I wouldn't particularly miss them if I gave 
them away at the moment, but I would still be losing all rights to having 
them at some future date when I might actually want them. I've therefore in 
theory given something up by giving away the tape or cd presuming I haven't 
made mp3s or something. When I gave away the actual purchased recording, I 
would then no longer have legal rights to keep any digital copies I made 
previously.
