One thing I always found scary is knowing whether your airbags are working or not. It's not like you can test them. What about the cars that are starting to show age? Would the airbags still deploy? YIKES! 'Tis always better to always wear seatbelts, IMO. I think everyone's advice would be to seek legal councel (sp?). This is some great advice....I spent 90 minutes today searching for a claimant who rear-ended one of our insureds, because the driver did not offer said info. All that I had to work with was a license plate number, fortunately written down by the insured. I found the perp in the end, though...:-) For a phantom vehicle incident, if it no contact was made between cars, that car/driver needs to be IDed and shown to be a causal factor (even if they have no insurance), but, if there WAS contact between cars, that ID is not required as the damage itself will prove the existence of said phantom car. For the most part, people are generally honest with insurance info, but as Henry proved, sometimes they are not. You should always get at least the license tag number, and the VIN, if possible. Also, call the police, even if they refuse to take the report (some won't if it's under $750). That way you have some proof of the the time and date of the accident. Always report the accident to your insurance company or agent, even if you apparently don't have damage, because the other party may make a claim against you, and believe me, YOU want to be the first to notify YOUR insurer (even if you are not at fault). The biggest advantage to is that we have better means to investigate and defend you in any claim made against you, and we could even help you settle your claim against "them". When in doubt, make the claim. Until money is paid, you should have the option of withdrawing your claim. It is sometimes called a "no-record" claim, and will generally not ding your policy (consult your agent for advice on this). One last thing...as a rule, for most insurers, the mere fact that you had an accident will not necessarily raise your rates. If this were the case, we wouldn't need underwriters, as they are the ones that decide how insurance-worthy you might be at any given time. Many things come into play, such as accident frequency, liability, etc. These "chargeable" losses may or may not be factors in an underwriter's review process. Comprehensive losses usually are not considered chargeable, as they are usually out of your control. Usual disclaimers apply, as I am not an underwater nor an agent, and I work for SF, so I can't say for sure how the others do it (though most US car policies are similar). First, I'm glad you are relatively alright. I don't know what you can do on black ice other than keep on steering but at some point you are simply become a passenger. I've been told by more than one BMW person that the airbags would deploy even though the SRS warning light was lit. I would have to think if it was life threathing they'd insist on repairing it right away. I don't know in what conditions airbags are supposed to deploy. I would imagine it's inertia that causes airbags to deploy, but I can not speak from experience. Do *you* want to contact a lawyer? Then contact a lawyer. I don't know why anyone would ask the advice of others. Only a lawyer can tell you if you have a case. Those that I've seen are in poor condition and have really high miles. I did see a okay '86 533i 5-speed, but the seller wanted way too much for it (almost CDN$9000 with taxes). Anyhoo, I'm getting this feeling that I'll be buying an automatic (ducking for cover...) after everybodys advice. And tonight I talked with the owner (lady) of an '83 528e auto. She's the 2nd owner (7 years), and the car has always been garage kept and serviced at an authorised BMW shop. No rust, dark green, few power options (which I think is good) , and 276,000 kms on the clock. She says she doesn't drive it hard, and uses it to commute to and from work. She is asking CDN$4500, but I'm hoping she will be able to lower the price when she sees my sad, desperate face... Advice? I'm going to call her back to say that I'll meet up with her (she lives 2hrs away in another city). Should I go for this? This 5-er is the best one yet, and my rental car is just a bunch on molded plastic on wheels! Of course I'll get another bimmer for me to do autox with, but this 5-er is for family uses only. HOWEVER, tell me what I can do to a 528e to make it go faster, handle better, etc... (can it be chipped?)
