You definitely need a key. Maybe HW preloaded one, I am not sure.
The Apex shipped with 9.0, which is just 8.0 but for the Apex.
Basically, there is a speed increase because of the better hardware in
the Apex, but no functional differences in the DAISY player (and even
several bugs that I have found).
