Portions of the day? Shortly? These terms are vague enough to absolve
themselves. They also may have made a mistake, or they may have gone back a
long time to one month that perhaps got a lot of hits.
This appears targeted to those people who can't stand the thought of someone
denied access to their content for any period of time. Most likely your site
is already being throttled, and would essentially be "disabled" if you
exceeded 'prescribed limits'.
This is typical Dot-Com rude behavior, that just months ago was amusing in
its audacity, but now has become extremely annoying.
Sure, you might be able to sue, but then your site would be taken down. Was
there a link to a document in the mail that gave more details? I would also
review the use agreement. It probably has more information that allows this
type or bad behavior.
