In any Berne Convention country, an author/creator automatically has
copyright in any work that is (1) original, (2) creative and (3) recorded in
a fixed medium. Thus you have copyright in your postings, provided they are
original and creative, I have copyright in mine, etc.

Where this gets interesting is when one tries to reach agreement on what
acceptable uses are implicit when one posts to a mailing list or its ilk.
Clearly, one has not given up one's copyright simply by posting to such a
group. Equally clearly, there is an implicit license to make copies for
certain purposes. The difficult area lies in between. I'm not sure what
the courts have decided since I last looked at this issue, but people
generally agree that the licensed uses are those implicit to the medium in
which one tosses one's messages. In this case, I there is an implicit
license to copy via e-mail clients and servers, as well as in other
Internet-based media, such as archive pages. But going to another medium,
such as CD-ROM, especially if offered for sale, thus impacting any potential
commercial value of the copyrighted expression, crosses the line, IMO.

Hey -- that's not how you play!

Nick
