Ah, I should have said "This is how I'd do it" --
rather than make a 'calculated' mark, I'd make a
distinctive and plausible mark, and get DNA evidence
to boot.  Interesting what advice a friend in law
enforcement might give.  Off the record, to be sure.
Of course, if he's unconcious, I could just pluck some
hair and take his wallet...or if near my car, tie him
up with the various horse gear I keep in the trunk.

BTW, your 'attacker suing' scenario - which has
happened - is why some of the personal defense advice
I've gotten is "off record."  <grimace>
