if SSL is defined httpd should complain about missing mod_ssl.so, etc.

I think you're wrong about startssl being depreceated.
Looking at apachectl in a recent checkout, I see the line:
startssl|sslstart|start-SSL)
    $HTTPD -k start -DSSL
and in httpd.conf and ssl.conf, things are wrapped in <IfDefine SSL>.
