It’s complicated. See: FCC Part 97 4th ed 97.305. Shared frequencies like 60-m 
are an exceptions to the rule. Generally I see that the FCC also designates 
certain modes for portions of bands. These obviously have the force of law. 

Band plans must comply with the regulations. I believe they are part of the 
expectation that we can be self regulating. I don’t believe they have the force 
of law. They may come from ARRL, and lately I have learned that they may come 
from a state committee as well. They seem to range from very strongly recommend 
as good practice to suggestions.
