AIUI, the tree remains the property of the landowner, but who is liable for the cost of removing it from other people's land, the highway, etc, so commonly it becomes the property of the person who removes it in lieu of such payment. Certailny when we were held up at Red Bull by a fallen tree the year before last, BW guys on hand were very happy to let us take as much as we needed, and offered us the use of their chainsaw to log it up.
