The fact that the MCA are involved makes me think that the smoking on boats 
ban only applies to boats which come under their jurisdiction - like 
passengers boats with more than 12 people. However, we plan to make the 
cabin of Bluebell, the community boat we are restoring , a No Smoking area. 
I don't see any problem with the driver or crew smoking on the back deck 
though.
I am not so sure about the smoking ban not applying in lorries. I seem to 
recall that there was a fuss when the smoking ban was introduced up here 
last year that lorry cabs had to become No Smoking areas at the Scottish 
border.
