Question?  Why should BW or any other groups (such as EA etc) be responsible 
for someones irresponsible actions?

 

If BW had been told it was there and they did nothing about it then yes I could 
see how they might be held responsible.

 

So my thought is you have to prove negligence on the part of BW, and as I don't 
think you can, I think the answer is no.
