strange thing is I remember hearing about this (the lawsuit) at least a
couple weeks ago on NPR I think.Maybe it was Air America.

Don't remember offhand, but the gist of the story was that the ACLU
wasn't sure it *could* sue because of other provisions in the Patriot
Act. My inference was that basically the Patriot Act itself contained
language that could potentially lead to prosecutions of people that
challenged the constitutionality of the Patriot Act.
