The ACLU had to go to court to argue whether it could disclose the fact that it is filing a lawsuit in the first place. That is probably what you heard on NPR.

Don't remember offhand, but the gist of the story was that the ACLU
wasn't sure it *could* sue because of other provisions in the Patriot
Act. My inference was that basically the Patriot Act itself contained
language that could potentially lead to prosecutions of people that
challenged the constitutionality of the Patriot Act.
