I thought it was the reverse: that "obscenity" was specifically catagorized as 
unprotected speech.

I can't remember, but I believe this also had to do with court cases brought by 
the FCC who were allowed to continue levying fines on "obscene" material 
because it was not protected speech.

Or so I remember.
