I am sure you have more info on this than I do, but you are aware of
the requirements under USERRA which provides job protection, yes? A
returning employee should receive a job with the same status and
seniority and be allowed to contribute to pension plans and accrue
other benefits. And pretty much can't be fired within six months for
anything other than extreme reasons.
