No... cigarettes and smoking are fine. One cigarette after dinner or before bed, for example, can be very calming for many people and poses no substantial health risk. There are many people that enjoy the occasional cigar or pipe with no adverse side-effects. Now nicotine on the other hand, by all our current rules that should be a controlled substance. But then again so should caffeine and alcohol (as we've beaten to death). Don't confuse the transfer method with the dangerous or additive substance. (Note that I don't smoke personally... I find it a disgusting habit. My personal peeve is the huge number of fiberglass filters lying around our streets and sidewalks - personally I think all cigarettes should be filterless. The Constitution doesn't say "promote the general welfare except where large lobby groups are concerned". In any case it's a stretch, in my opinion, to say that ones personal health decisions have much impact on the "general welfare". I agree completely with laws that prevent a person's decision from harming others (DUI laws and the like) but not with laws that restrict a person's choices with their body in private. I'm on the fence on addictive substances in general just because our laws are so hypocritical about them.
