ah, okay then.

he sounded good. he was actually answering questions. which is kinda refreshing.

and yes, I know, he could have his game face on and turn out to be a
total turd in that punchbowl we like to call the USSC, but still...

Could we actually have an appointee that is not only qualified for the
position, but might actually turn out to be good in the long term?

to answer Dana, I too am worried about reporductive rights, but
everything I have heard today and read about the guy has indicated
that he is not into legislation from the bench, that Stare Decisis is
his modus operandi. He was indicating today that specifically in
reference to Roe v. Wade, that the original decision of the court was
upheld and affirmed as precedent by more recent USSC desicions. That's
encouraging, because he's essentially saying that precedent leads to
stability in the law.

On the other hand, he mentioned that in certain cases (most notably
Brown v. Topeka Board of Education, essentially overturning Dredd
Scott v. Stanford) might change his opinion on following the tenet of
stare decisis, given that the facts of the case prove that the
original decision is no longer workable or applicable.

I'm still thinking he should have been left as nominee for Associate
Justice rather than having him switched to the new nominee for Chief,
but if he turns out to be as level headed and rational as he appears
right now, maybe having him jump in as Chief Justice wouldn't be such
a bad thing.
