The use of WP in Falluja is a non-issue. Its been an accepted muntion since WWII. It never has been considered to be a chemical weapon. The treaty some have been ranting about has been the protocol on using incindiary weapons on civilian targets. The US has never signed it in the first place, so how can its provisions apply?
