Well, just because they aren't president anymore doesn't mean their
executive orders don't still stand. Bush would have to void each one.

As for the patriot act provisions, I don't know exactly what they were and
where the executive orders overlapped the law.

I think the patriot act allowed the FBI and CIA and other agencies to do
this without the backing of the executive branch. So regardless of what the
President wants, the FBI could eavesdrop on someone.

The Patriot act allowed for certain sweeping items without the need for two
things, a court order, or executive backing.
