Depends. I don't know the ToS, but there could certainly be some verbiage in there that states that whether or not you own the phone, you're using it in conjunction with their services, and you agree to use it in a specific manner.
I don't agree with it...in fact, I think it sucks. I mentioned in another thread that I have the XV6600 under Verizon. Natively, the phone is supposed to be wi-fi enabled. but Verzion cripples it because they don't want people getting online unless it's through their EVDO service (which runs $45 a month for unlimited data). I'm sure I could somehow re-enable wi-fi (well, i could just get an SD card with wi-fi)...but if I did modify the hardware, I wouldn't expect Verizon to be particularly happy. On an unrelated note...I'd be perfectly happy to pay $20 a month for the unlimited data plan. But given that I'm almost always in front of a computer anyway, I can't justify $45 (especially when I'm paying that for broadband at home).
