Yes he does. But that will eventually be reviewed so they'd better have a reason. In this case the President went to Congress and NSA and got the go ahead first. Set up a review process and had it re-evaluated every 30 days. This was top secret so it couldn't go before the entire congress. Now that al Qeada knows about it it's useless.
