These efforts are against the contents of data. It would make no difference if the root servers were elsewhere.
This is the data of a private company operating in the US. I don't think the government has any right to retrieve the data on the grounds they are using. However should there have been an actual need to get it based on a crime that has been committed, and this would be direct evidence of that crime, then the government should be able to subpoena that info. Of course, I think they crap about this devaluing Google is just that, crap.
