It's bigger than that, Kevin. Your specific examples are trumped by considerations above and beyond the specific situation.
While the smoker may not be personally bothered by smoke, they are certainly bothered by some other action. Since they know that they don't like it when someone else ignores their concerns and acts in a certain way, they should extend the same courtesy to others. Be it smoking or anything else. The same applies for your sex example. A religious minded person laying out educational curriculum should do so according to the statutes, especially the separation of theology and science.
